Who Can Claim Asylum?

Under the 1951 Refugee Convention, a person can claim asylum in the UK if they have a well-founded fear of persecution in their home country based on one of five protected grounds:

  • Race: Persecution based on your racial or ethnic background
  • Religion: Persecution based on your religious beliefs or practices
  • Nationality: Persecution based on your national origin
  • Political opinion: Persecution based on your political views or activities
  • Membership of a particular social group: Including LGBTQ+ individuals, women facing gender-based violence, and others

Humanitarian Protection

Even if you do not meet the strict definition of a refugee, you may be entitled to Humanitarian Protection if you face a real risk of serious harm in your home country, including the death penalty, unlawful killing, torture, or inhuman or degrading treatment.

The Asylum Process

Claiming Asylum

You must claim asylum as soon as possible after arriving in the UK. Claims are made at a port of entry or at a Home Office screening unit.

Screening Interview

A short interview to establish your identity, nationality, and the basis of your claim. You will be given an Application Registration Card (ARC).

Substantive Interview

A detailed interview about your experiences and reasons for claiming asylum. This is the most important stage — thorough preparation is essential.

Decision

The Home Office will decide whether to grant refugee status, humanitarian protection, or refuse your claim. Decisions can take many months.

Appeal (if refused)

If your claim is refused, you have the right to appeal to the First-tier Tribunal. We represent clients at all stages of the appeals process.
